When Esha Gupta and Emraan Hashmi romanced each other in
the most adorable way in Baadshaho’s the peppy number Socha Hai (remixed
version of the famous song Keh Doon Tumhe from Deewar) fans went crazy looking
at their chemistry. Not just for its visual appeal, the song was being
appreciated for not tampering the classic.
However, unfortunately, we will not see the song anymore
on any platform. It’s been pulled out from the movie and social platforms as
well.
In a judgment passed by the division bench of the Mumbai
High Court yesterday, Rajiv Rai (owner of Trimurti films who had the rights of
the original song) won the case against Bhushan Kumar's music company Super
Cassettes Industries. According to the verdict, Baadshaho makers cannot use the
song at all on any medium.
Reportedly, Rai's Trimurti Films entered into a contract
with lyricist Sudhir Ludhianvi and composer RD Burman in 1974. Since then it
owns the copyright of the lyrics and music of the song.
Esha Gupta And Emraan Hashmi In Baadshaho's Socha Hai
On January 2, 1974, the company entered into an agreement
with Polydor (now Universal Music India), granting them the right to make and
sell gramophone records of songs from Deewar, and the mechanical reproduction
rights for this limited purpose.
While speaking to mid-day, Rai said, "When you make
a song, you sometimes give the remix rights to the music company. But, in this
case, we had not given the rights to Polydor (Universal). So when T-Series took
the remix rights from Universal, the company told them categorically that if
Trimurti Films sues them, they will have to fight it out. It's not just a fight
for me, but for all producers in Bollywood."

On the other hand, Bhushan Kumar (MD and chairman,
T-Series) has abided by the judgement and dropped the song from the movie and
pulled it down from all networks. However, he added that T-Series has always
bought recreation rights from the respective music companies. This is the first
time that the rights were fractured.
Well, looks like fans will surely miss a good number in
the film!
