Online Shopping Sites Misusing Priyanka, Kangana, Sunny Leone's Faces To Sell Sarees

Bollywood actresses steping out in amazing sarees at various events are a treat to watch.
In fact, if you look at online shopping sites today, most of them claim to be selling sarees (color and design same to same) worn by the actresses at public events which made news in the media. But if you think you are buying a Kangana Ranaut/Priyanka Chopra/Shilpa Shetty/Sunny Leone saree online, think again!
SpotboyE.com brings you the news that these sarees arent the ones, which the celebrities wore at any function whatsoever. Their quality is comparatively inferior.
We also have it that many of these heroines are extremely disturbed about this and have been thinking of initiating legal action against the online shopping sites. Thats the story.
Kangana Ranaut, for one, we believe, has already sent a legal notice to some of these portals.
Advocate Rizwan Siddiquee has many such clients from Bollywood, who are up in arms against these sites.
We also know for a fact that one more leading heroine from the above mentioned list is also taking legal recourse for the same.
In response to Kanganas objection, the portals have written back to Siddiquee: “Our online market place acts only as an intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000 wherein independent buyers and sellers interact with each other. Were not engaged either in manufacturing of any product and/or sale or offering for sale/advertisement and/or distribution and/or stocking of any product whatsoever.”
However, Siddiquee feels that the portals in question are simply playing'passing the buck'. When contacted, he said, The websites, which act as a sale and purchase platform for third party products, are called intermediaries. Such intermediaries have not gained full immunity under Section 79 of the Information Technology Act 2008 and therefore they cannot get away by openly selling spurious or fake copies of original products on their platform. Such websites, which are owned and operated by companies and other entities, are fully aware that in doing so, they are not only violating the rights and liberties of the original intellectual property rights holder but also attracting various provisions of Indian Penal Code. All such companies and the people behind management of such websites are fully aware that when they are using photographs of celebrities to sell spurious or fake copies of original products, they are willfully and openly violating the intellectual property rights and liberties of various reputed designers as well as the said celebrities.
Added Siddiquee, "They cannot then feign ignorance about the same and conveniently state that they never monitor their own websites and are therefore not aware of sale of spurious and fake copies of original products on their websites. Section 79 2(c) casts strict liability on the intermediary websites and make them liable to discharge their duties with due diligence. Such open acts of sale of spurious products and fake copies, on such intermediary websites sufficiently prove that no due diligence work has been undertaken purposely and mischievously by the websites to openly promote sale of such spurious and/or fake copies of original and thereby boost their sales and earn commissions and profits therefrom."
