The ink on President Joe Biden's signature was still fresh when the legislation to ban or compel the sale of the Chinese app TikTok became official. This move by the US Congress was underscored by concerns over national security, citing the app's ties to ByteDance, a Chinese entity. In response, TikTok vehemently refuted these claims, emphasizing its commitment to safeguarding user data and distancing itself from any affiliations with Beijing. CEO Shou Zi Chew made it clear that TikTok intends to challenge the legality of the new law in court, signalling a forthcoming legal battle.

The ban echoes a similar action taken by India approximately four years prior, when the government opted to bid adieu to TikTok and other Chinese apps. Citing privacy and sovereignty concerns, India's decision was met with widespread support, particularly in light of tensions along the India-China border. The ban in India, however, was swiftly executed, with Chinese companies given an opportunity to address privacy issues before the ban was made permanent in January 2021. In contrast, the road ahead for TikTok in the US appears more arduous due to its substantial revenue market and the robust protections afforded by the First Amendment.

Digital policy expert Nikhil Pahwa underscores the need for countries to reassess their reliance on Chinese technology, emphasizing the potential national security risks posed by these apps. TikTok's ban extends beyond India, with Pakistan, Nepal, and Afghanistan also implementing prohibitions, while several European countries have imposed restrictions.




As the global debate surrounding TikTok continues to unfold, the spectre of national security looms large, prompting nations to navigate the delicate balance between technological innovation and geopolitical concerns.
