Amber Heard does not seem satisfied with the verdict of the defamation case filed by her former husband Johnny Depp. The case has been in discussion throughout 2022 and it has effortlessly managed to grab eye-balls throughout its course. However, now a recent report suggests that Amber Heard is seeking a new defamation trial against the actor.
Earlier this month, the Aquaman actress filled a new defamation trial against the actor, claiming that the court battle that she lost was “stacked against her,” reported The New York Post. Meanwhile, Amber’s new lawyers have also made a series of assertions in a recent court appeal claiming that the trials were ‘unfair’.
For those unaware, the 'Pirates of Caribbean star Johnny Depp was awarded $10.35 million after he won the case. Ultimately, the actor won the defamation suit after it was found out that the claims made by Heard in a Washington Post op-ed were defamatory.
Heard in her op-ed claim that she was a victim of domestic abuse during her marriage with Depp.
Amber’s counsel submitted a 68-page document and argued that the exclusion of Heard’s “therapy notes”, in which she wrote about the abuse, led to an “unfair verdict”. To note, Heard’s therapy notes were also ruled out during the trials at Fairfax County as hearsay by Virginia Court Judge Penney Azcarate.
“The trial court improperly prevented the jury from considering several separate instances in which Heard reported Depp’s abuse to a medical professional,” the court document read, which was dated on November 23.
“The trial court also erred in overruling Heard’s demurrer, in which she argued that the challenged statements are non-actionable expressions of opinion and are not reasonably capable of conveying the alleged defamatory implication,” the court docs read.
“That holding, if allowed to stand, undoubtedly will have a chilling effect on other women who wish to speak about abuse involving powerful men,” it continued. “This case also should never have gone to trial because another court had already concluded that Depp abused Heard on multiple occasions,” the appeal read.
Questioning the relevance of the Virginia trials, Heard’s lawyers wrote, “the case should never have gone to the trial because another court had already concluded that Depp abused Heard on multiple occasions”.
