Veteran actor Dilip Kumar and Saira Banu can heave a sigh of relief. According to Times Of India, Bombay High Court Bombay (HC) has cancelled an arbitration tribunal’s order which asked the legendary actor to give an undertaking to secure property worth Rs 25 crore in a dispute with a builder, Sameer Bhojwani.
A report in Mumbai Mirror states, “Justice BP Colabawalla, in a judgment on Monday, observed that the tribunal’s order amounted to converting Prajita Developers’ claim into a “secured claim,” even when it was only about seeking damages for a deal gone wrong.”
Meanwhile, Times Of India quoted Justice Colabawalla saying, “Looking at it from any angle, the tribunal was wholly unjustified in directing Kumar to give an undertaking that he will not alienate or encumber or part with possession of the property which was subject-matter of the arbitration to the extent of Rs 25 crore till the proceedings are concluded. It was irrelevant whether the undertaking was in respect of specific property or any other unencumbered personal property belonging to Kumar.”
For those who’ve come in late, Bhojwani has been reportedly claiming Rs 176 crore in damages from Dilip Kumar for backing out of a 2006 agreement to redevelop his bungalow in Mumbai, Bandra. In January 2018, Dilip Kumar and Saira Banu had lodged a police complaint against Mr Bhojwani placing allegations against him on the grounds of forging title documents of their bungalow worth Rs 250 crore. Later, in January, this year, the couple sent a defamation notice to the builder for falsely claiming ownership to their Rs 250 crore property that’s located in the suburbs of Bandra. They have sought for an apology from Mr Bhojwani and Rs 200 crore in damages for defaming them in public.
The notice sent by the actor stated, “Bhojwani has damaged the reputation of Dilip Kumar and Saira Banu in public by making false and defamatory statement against them. On the basis of forged and fabricated documents, Bhojwani is claiming ownership of a property, originally owned by Dilip Kumar and Saira Banu. Dilip Kumar and Saira Banu are the legitimate owners of the property situated at Pali Hill in Bandra and have acquired the same in September 1953. Bhojwani issued the public notice on December 21, 2018 with a criminal intention to grab/encroach the legitimate rights of Dilip Kumar and Saira Banu by creating a perception in public that he (Bhojwani) is the owner of the property.”
